These Terms of Use govern your access to and use of the Fortezza application and related account services provided by Fortezza Group, LLC ("Fortezza," "we," "us," or "our"). By using the service, you agree to these terms. If you use the service on behalf of an organization, you must have authority to do so. If you do not agree, do not use the service.

A separate written agreement with Fortezza may govern your organization's equipment, subscription, support, or other services. If that agreement conflicts with these terms, the separate agreement controls for the services it covers.

Authorized accounts

Use the service only through an account you are authorized to use and within the permissions assigned to you. Keep your account credentials and verification codes confidential. Provide accurate account and contact information and update it when needed. Contact support promptly if you suspect unauthorized access or a compromised account.

Your organization is responsible for deciding who may access its equipment and for managing its users' permissions. Fortezza may require verification of a contact method or an unfamiliar browser before providing account access.

Permission to use the service

Subject to these terms and any applicable separate agreement, Fortezza permits you to use the service for authorized monitoring and operation of supported equipment. This permission does not transfer ownership of the software, documentation, trademarks, or other intellectual property.

You retain rights you have in information you or your organization provide. You authorize Fortezza and its service providers to process that information as needed to provide, secure, maintain, and support the service, as described in our Privacy Policy.

Equipment operation and safety

The service may display equipment status and send commands to connected equipment. Network conditions, power failures, hardware issues, configuration, and other factors can delay or prevent readings and commands. Displayed information may be incomplete or out of date. Sending a command does not guarantee that equipment received or executed it.

You are responsible for ensuring that a command is authorized and safe under the conditions at the equipment site. Follow applicable operating procedures, equipment instructions, safety requirements, and laws. Maintain appropriate local safeguards and emergency controls. Do not rely on the application as the sole means of preventing injury, property damage, or equipment failure, or as a substitute for required safety systems or emergency response.

Acceptable use

Do not access equipment or information without authorization; bypass access controls or verification; interfere with the service or its security; introduce malicious code; misuse verification or recovery messages; infringe others' rights; or use the service unlawfully. Do not share accounts or use another person's contact information without authorization.

Email and SMS security messages

Fortezza may send service-related email for account verification, security, recovery, and support. Where SMS verification is available, you may choose to receive Fortezza security codes at a telephone number you are authorized to use. SMS consent is separate from agreement to these terms, and SMS is not required to use the service; email verification is available as an alternative.

The Fortezza security messaging program sends verification codes for contact confirmation and unfamiliar-browser sign-ins, and may send account recovery messages. Message frequency varies with your requests and account activity. Message and data rates may apply. Mobile carriers are not responsible for delayed or undelivered messages. Delivery of a message or code is not guaranteed.

Reply STOP to opt out of SMS messages. For assistance, contact support@thefortezzagroup.com. After opting out, use email verification or contact support for help with account access. Do not share a verification code with anyone or use a code you did not request.

Our Privacy Policy describes how we handle contact information and SMS consent records. We do not share mobile opt-in information with third parties or affiliates for their marketing or promotional purposes.

Availability, changes, and suspension

We may maintain, update, or change the service, and availability may be affected by maintenance or circumstances outside our control. Any specific availability or support commitments must be stated in a separate agreement.

We may restrict or suspend access when reasonably necessary to address unauthorized activity, security risks, unsafe or unlawful use, a violation of these terms, or a legal requirement. Your account administrator may also change your permissions or deactivate your account. Any termination or other rights under a separate agreement remain subject to that agreement.

Privacy

Our Privacy Policy explains the collection, use, and disclosure of information in connection with the service. Review it at fortezzatech.com/privacy. You are responsible for having authority to provide information about other people or equipment through your account.

Disclaimers and responsibility

Except as expressly stated in a separate agreement, and to the extent permitted by applicable law, the service is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or suitable for every equipment configuration or operational purpose. Nothing in these terms excludes a warranty, right, or remedy that cannot lawfully be excluded.

Any limitation of liability agreed in a separate written agreement applies according to that agreement. Each party remains responsible as provided by applicable law, subject to any applicable agreement.

Changes to these terms

We may update these terms as the service changes. We will publish the updated terms with a revised date and provide additional notice when required by applicable law. Changes do not override a separate agreement except as that agreement permits.
